Petroleum / Hazardous Liquids Storage Tanks Permitting & Registration

Wisconsin Administrative Code ATCP 93 requires facilities that store, transfer, or dispense flammable, combustible or hazardous liquids to be registered with DATCP. The following types of tanks are exempt from the registration requirements:

  • Aboveground tanks with a capacity of less than 5,000 gallons

  • Tank vehicles
  • Portable tanks, and moveable tanks that are located on a property for fewer than 24 months

  • Tanks that are located at a US EPA superfund site

All in-use and temporarily-out-of-service storage tanks that are used to store a regulated substance must have a permit to operate from DATCP. The following types of tanks are exempt from the permitting requirements:

  • Aboveground tanks

  • Farm and residential underground storage tanks with a capacity of less than 1,100 gallons which are used for storing motor fuel

  • Underground storage tanks storing heating oil for consumptive use on the premises

  • Tanks located at a US EPA superfund site
